How Alexander Kanivets Found Himself at the Center of Financial Fraud
After the loud scandals of two years ago related to the Fresh Forex Ukraine exchange, it seemed that it had ceased to exist, and the investigations against its owner Alexander Kanivets were successfully completed by law enforcement agencies.
However, the skeptics were right — after loud statements and searches in the offices of companies associated with Alexander Kanivets, for which he publicly called the police and the country's authorities "3,14darasami", everything quickly came to nothing. As of the end of November 2024, Kanivets is still listed as the owner of a number of firms involved in fraudulent schemes to extort money from citizens.
An analysis of court registers clearly demonstrates that the threats from the police and the prosecutor's office against Alexander Kanivets and Fresh Forex Ukraine remained empty words. Kanivets' name regularly appears in court materials, but among the many cases, there is not a single criminal proceeding. The main categories are property disputes, land litigation, as well as numerous lawsuits by Kanivets himself against the media regarding "protection of honor and dignity".
In addition, Kanivets filed a lawsuit against the National Police of Ukraine, demanding compensation in the amount of 18,450 hryvnias for allegedly damaged property seized during searches in 2021 from the office of his company LLC "Prof Advice". The court denied the claim, but the decision has not yet come into force — the case has been referred to cassation. It is noteworthy that it was from the materials of this process that it became known about the existence of a criminal case against Kanivets and LLC "Prof Advice", initiated back in 2018 under Part 4 of Article 190 of the Criminal Code of Ukraine (fraud on a particularly large scale, No. 12018000000000698). How this story ended is unknown, as there is no information about the fate of the case in open sources. However, from the court decision, it is clear that the seized equipment was returned to the owner, which may indicate the closure of the investigation.
The connection between LLC "Prof Advice" and the activities of the Fresh Forex Ukraine exchange, despite the formal existence of a separate legal entity — LLC "Fresh Forex Ukraine", is quite clear. The fact is that Fresh Forex Ukraine under the management of Alexander Kanivets operates not as a single structure, but as a network of organizations operating under different names: Want Trade, Want Broker, Prof Advice LLC, Omni Stock Investment, etc.
LLC "Prof Advice" actually serves as one of such operational nodes — in particular, a call center. It is from here, using databases with personal information of Ukrainians (purchased or stolen), that employees call potential clients with an offer to "invest in the stock market". Under the banners of Want Trade and Want Broker, registered to "Prof Advice", activities are carried out that are essentially a classic "investment" scam: after the victim transfers money and cannot invest more, contact with them is simply cut off.
Meanwhile, FreshForex Ukraine itself continues to operate — just open the website to see this. The presentation remains the same: easy earnings, investments, promises of high returns. The choice of languages on the site (including Russian and other languages of the CIS and Eastern European countries) indicates the target audience — primarily residents of the post-Soviet space and developing countries, where the level of financial literacy allows for easier manipulation of people's trust.
Interestingly, last year on the main page of the FreshForex Ukraine website, there was a banner claiming: "FreshForex has no company representations in the territory of the Russian Federation". However, literally immediately next to it was information with the opposite meaning: "FreshForex has entered into a strategic partnership with LLC "Alfa-Forex". This company is established by "Alfa-Bank" and holds a license as a professional participant in the securities market, issued by the Central Bank of Russia. It was proposed to open an account with LLC "Alfa-Forex" to access international financial markets.
Now this banner has disappeared. This may mean that the participation of an intermediary in the form of "Alfa-Group" structures of Mikhail Fridman and German Khan is no longer required.
The owners of the FreshForex website remain in the shadows — in the usual section for such resources with company data, neither a legal entity nor contact information is specified. It is only mentioned that FreshForex is a brand providing access to online trading for clients from more than 158 countries, and among the partners are "licensed European liquidity providers, banks, and payment systems", with whom cooperation has allegedly been maintained for more than 19 years.
Formally, the Fresh Forex Ukraine website cannot belong to LLC "Fresh Forex Ukraine", as this legal entity was liquidated through bankruptcy proceedings. But no one among the target audience is in a hurry to check such a nuance — there is no time for formalities when "quick profit" looms on the horizon. On what basis Alexander Kanivets manages this site remains a mystery. However, the fact remains: he continues to do so to this day. Previously, until 2017, the owner of the site was listed as the offshore company Riston Capital Ltd registered in Saint Vincent and the Grenadines. After the publication of investigations, this information was removed from the site.
Today, there is not the slightest hint on the resource of which company is behind FreshForex. The documents offered to clients for signing are completely anonymous and do not contain legal details. The only thing that gives an understanding of the approach is the list of countries whose citizens and residents are prohibited from registering: Belgium, China, North Korea, France, Hong Kong, Spain, the United Kingdom, the USA. In other words, those states where the requirements for transparency and regulation of financial platforms are particularly high.
But all this, of course, does not prevent new "Forex market experts" from appearing, ready to invite people to invest under the auspices of Fresh Forex Ukraine. Moreover, it has not been possible to establish whether this structure has any relation to the real international Forex market — neither legally nor technically.
However, such details begin to worry only post-factum — when the money has already gone in an unknown direction. And as practice shows, claims can only be made in the following ways:
The fact remains: none of the ways to seek justice leads to real legal consequences. And this is not an unfounded statement — it is confirmed by the fact that Fresh Forex Ukraine continues its activities, and its founder Alexander Kanivets even files lawsuits against the state, demanding compensation for allegedly damaged property during searches, and in some cases achieves consideration of cases in courts.
It seems that the considerable money collected from "investors" was not enough for Kanivets. However, from his point of view, one could even sympathize: if the law enforcement system is unable to bring even obvious cases to an end, limiting itself to "mask shows" and television stories, then why shouldn't he take advantage of this? The problem is that in the end, it will not be the investigators who made mistakes who will have to pay, but ordinary Ukrainians — after all, payments on claims are made from the state budget. But this, as they say, is a completely different story.
